Hawala Case a conspiracy against Advani ji
as
he has told the nation and party workers ?
Questions
unanswered by Mr. Advani since April
1997.......
Respected Advani ji,
Ever since you have been chargesheeted in the Jain Hawala Case, you
have been branding it as a mere conspiracy against you. On being discharged by
the Delhi High Court on April 8th 1997, you celebrated it like a moral victory.
I am surprised how a leader of your stature can mislead the nation and his
followers by concealing facts.
Don't you know that Hawala case is connected with the funding of
Hijbul-Mujahideen in Kashmir ? You know that in March 1991, two Muslim youths
were caught red-handed with several lacs of rupees in their possession.
This money was being sent to the militants in Jammu and Kashmir. On
their tip off the Delhi Police and the CBI raided several 'Hawala' operators
and subsequently the Jain brothers. A huge recovery of cash, gold bars, foreign
exchange and several incriminating documents were seized in these raids. Yet
CBI hushed up the investigation under political pressure.
1. Do you feel that the police should not have raided
the Hawala operators?
2. Do you think that these youths should not have
been booked under the provisions of TADA even when they were channelising the
funds to the militants of Kashmir?
3. Do you call it a conspiracy to safeguard national
interest ?
4. You know that once CBI came to know about the
involvement of a number of top politicians with the Jain brothers, the entire
investigation was put in cold storage? Was it a conspiracy against you or
against the nation ?
5. When everybody who matters in Indian politics is
allegedly involved in the Hawala case then who did conspiracy against whom ?
6. You know very well that whatever pretention of
investigation CBI did, it did so after our petition was favorably taken up by
the Hon'ble Judges of the SC? Then whom are you blaming for the conspiracy ? Us
or the SC Judges?
7. Why were you so scared of facing the Kalchakra's
TV cameras in Aug. 1993, when in the past you had always welcomed us ? We were
to ask you only two questions a) Do you know the Jain brothers ? b)Have you
taken so much money from them ? If you had nothing to hide, you could have
easily answered our questions.
8. You were chargesheeted in Jan.1996 while your name
started appearing in Hawala case since July 1993, if it was a conspiracy why
didn't you raise an alarm during this long period ? Were you presuming that
nothing will happen, no one will be caught so why trouble the trouble unless it
troubles you ? Should it not be termed as a conspiracy of silence by you and
your party ?
9. Knowing fully well that it was case of treachery
with the nation, yet why did you not raise any voice in the parliament or
outside demanding a thorough probe into the matter ? As a leader of opposition
was it moral on your part ? If not, then how it is your moral victory ?
10. Does your heart bleed for the Hindu refugees
living in camps at Jammu? If yes why didn't it bother you to find out the roots
of Hawala funding?
11. Was it moral for Mr. Ram Jethmalani to betray us
and change side to protect your interest ? Was it moral for you to make him a
Law Minister, by denying this opportunity to several of your senior party
colleagues, when he was not even a member of your party ? What was the
understanding ? That he will help you to get out of the Hawala case ? Otherwise
how is it that such a brilliant legal brain did such an illegal act of making
contemptuous statement? As a law minister he said that he would file an
affidavit to say that you were innocent. This amounts to tampering with the
process of law. With such immoral acts do you still call it a 'moral victory'?
12. You know that CBI filed false information in the
SC to protect the politicians. CBI told lie that it was 'vigorously pursuing
the investigation' while it had done nothing. It further told lies that Jains were
absconding while they were throwing parties in Delhi. CBI told lies that it
could not identify currencies of 50 unknown denomination seized from Jains.
What a joke ? CBI underplayed the facts before the Delhi HC. It is a case based
on repeated lies to protect the powerful politicians like you, yet how do you
call it a victory of 'truth over untruth'?
13. Anyway now you feel 'relieved from the burden'. Do
you now have the moral courage to demand honest probe into the Hawala case and
punitive action against the officials of CBI who shamelessly connived with the
accused? Can you explain the nation why you don't want thorough probe in
Hawala, while you had shaken the whole nation demanding probe in the BOFORS
case?
14. Finally, you do realise that your and your party's
phenomenal rise in 1990 had been due to the mercy of Ayodhyapati Bhagwan Shri
Ram. He can make or unmake our lives. Do you have the moral courage to swear by
touching the lotus feet of Shri Ram Lala at Shri Ram Janmabhoomi and declare
publicly that it was a conspiracy against you and you had accepted no money
from the Jain brothers?

Respected Advani ji,
Your enthusiasm to find the truth of BOFORS scam is worth appreciating.
What impresses us is the persistence with which you and your close associates
have been after this scam since 1987. You and your party has shown similar
enthusiasm in the Fodder Scam and is all set to exploit this issue in the forth
coming assembly elections of Bihar. In all fairness should you not show the
same enthusiasm in finding the truth about the Jain Hawala scam ? The recent
blast in the Pooja Express and repeated attacks on army camps in Kashmir are
lethal blows on Indian state by the militants, who are flourishing without any
check.
This is not the first time I am communicating with you. During the past
6 years I have been asking you some questions related to the Jain Hawala Case
through my letters, Kalchakra newspapers, public and press statements and so
on. It is unfortunate that you being such a senior and respected leader of the
country have been avoiding all of them. If this was not enough you very easily
branded the Jain Hawala case as a mere conspiracy against you, when you were
chargesheeted in this case on 16th Jan1996. When you were let off by the Delhi
High Court on 8th April 1997, you called it your "moral victory",
"a victory of truth over untruth" and so on. It was then I had
released a set of questions for you to answer, but you preferred to ignore
them. Instead of respecting the democratic traditions of public accountability
you directed your entire man power to launch a world wide misinformation
campaign on Hawala case. In several public meetings in India and abroad I had
to face some of your campaigners who were very hostile towards me for having
"unnecessarily dragged" your name into this case. By God's grace I
was able to satisfy them with logical explanations and correct information. On
the contrary I have yet to receive your answers to my questions.
Let me tell you that this attitude of yours proved fatal for the
country. The militants felt more secured than ever before. They realised that
the ruling elite of India are really not interested in curbing their
activities. They could see that all the concern Indian political leaders show
for the growing militancy is nothing more than lip service. Their confidence
grew so much that they could dare to plant a bomb in your public meeting at
Coimbatoore. By God's grace you narrowly escaped, however, several innocent
people of the town had to lay their lives in that gruesome blast.
Since the militants are gaining in strength day by day, they could dare
to enter the army establishments in Kashmir and killed several of our officers.
From across the border they are throwing open challenge to Indian state. They
have already established a vast network in this country. It has become an
alarming situation.
The people cannot be left at their mercy. You know that the Jain Hawala
case is one major case related to the funding of militancy in India, which has
yet not been properly investigated. Even the former Chief Justice of India, who
monitored this case said on 28th August 1998 that CBI failed to properly
investigate the Hawala case otherwise the politicians would not have been let
off.
I am sure by now you must have read my book on this case. It explains
how shamelessly and systematically the entire Hawala probe was scuttled by the
ruling elite of this country.
In light of the above facts and the material published in this
newspaper, don't you think that this case needs to be probed by a team of
efficient and honest police officials ?
Don't you think that your continuation as the Union Home Minister will
seal the possibility of honest probe into this significant case ?
Please do not think that we have an agenda to chase you on this issue.
On the contrary we feel that you are a strong leader with a vision and we have
some hopes from you for this nation, that is why we want you to have the moral
courage to come-out openly and share the truth with the nation as several other
Hawala payees including your cabinet colleague Mr. Sharad Yadav did. You know
that the President of USA, Mr. Bill Clinton had no ego problem in accepting
that he had lied and actually had relations with Monica Lewinsky.
People of USA forgave him thereafter. Will you do that respected Advani
Ji and will also request the PM to ensure proper investigation in this case ?
